What happened
The Trump administration just scrapped the “disparate impact” standard—the legal tool that’s been used for decades to prove discrimination even when it’s not spelled out. It’s how we’ve held banks accountable for redlining. How schools got challenged for punishing Native students more harshly. It’s how systemic racism gets exposed in court.
Now it’s gone. They’re calling it “unconstitutional.” Translation: they’ve decided civil rights don’t matter if you can’t prove intent.
What it reveals about the playbook
This is authoritarianism by erasure. Don’t want to look racist? Change the rules so you don’t have to. This is how power protects itself—by gutting the mechanisms that reveal harm and pretending the harm no longer exists.
It’s a cruel strategy.
What to do
Flood Congress. Call your Senators and House Reps and tell them to defend civil rights protections—especially the right to challenge policies with discriminatory outcomes. Demand legislation that locks disparate impact into law.
